Nebraska does not authorize syringe service programs. A 2024 bill, LB 307, would have let municipalities and counties establish them and carved out paraphernalia exceptions, but Governor Pillen vetoed it on March 4, 2024. Naloxone access is more solid: a statewide standing order lets people get it without an individual prescription, and the Department of Health and Human Services runs a no-cost distribution program on top of that. Nebraska's Good Samaritan protection (Neb. Rev. Stat. 28-472) creates an exception from criminal liability for someone who seeks help during a drug overdose. Fentanyl test strips are legal, pharmacists may sell them over the counter, and local public health departments distribute them as part of their own prevention efforts.
The Nebraska Harm Reduction Program, run through the University of Nebraska Medical Center's College of Public Health, pairs a lived-experience instructor with evidence-based public health support to train people and organizations on recognizing overdoses, responding to them, and identifying the barriers that keep people who use drugs from getting care. The state's Opioid Recovery Fund appropriates $2.5 million a year to Nebraska's behavioral health regions specifically for prevention and harm reduction, and the Nebraska State Opioid Response program, running since October 2019, funds naloxone distribution, provider training, and medication collection efforts statewide.
Without a legal syringe program framework, naloxone and test strip access through DHHS and local health departments is the realistic starting point in Nebraska right now.
