Harm Reduction in Delaware

Delaware's syringe exchange program is run by Brandywine Counseling and Community Services, and paraphernalia obtained from it is exempt from criminal liability under state law. Fentanyl test strips followed the same path: they were treated as paraphernalia until Governor Carney signed a 2021 law allowing their distribution. Naloxone is available through Delaware's Community-Based Naloxone Access Program, with participating pharmacies dispensing under a standing order. Delaware has two separate Good Samaritan laws that together provide both criminal and civil protection for anyone who acts in good faith to help someone who has overdosed on drugs or alcohol.

The Division of Substance Abuse and Mental Health's State Opioid Response project focuses specifically on five populations who are often underserved elsewhere: pregnant and parenting people, racial and ethnic minorities, justice-involved people, LGBTQ+ individuals, and young people. Delaware held its first statewide Harm Reduction Conference with SAMHSA grant support, drawing roughly 300 people from the treatment system, first responders, and community organizations together in one place, and the state's Overdose Response Center tracks fatal and non-fatal overdoses in near real time to help direct resources where they are needed fastest.

Brandywine Counseling and Community Services is the most direct starting point for syringe access specifically, since it is the state's sole designated provider.
