Michigan is the outlier among Ohio's neighbors: it has no state law authorizing syringe service programs at all. State paraphernalia law technically only targets people selling drug equipment, not the equipment itself, so programs and participants operate in a legal gray area rather than outright illegality, but some cities and counties have passed local ordinances banning syringes and other supplies outright, adding another layer of risk on top of the missing state framework. A bill (Senate Bill 629) that would authorize and protect syringe programs passed the House unanimously in December 2024 before stalling in the Senate. Fentanyl test strips are in a similar spot: Michigan's paraphernalia law does not reach personal possession, so strips are already legal to carry, and a separate bill (House Bill 5179) aims to make that exemption explicit rather than implied. Michigan's naloxone standing order, in place since 2016, lets any pharmacy dispense it to anyone without a prescription, and the state's Good Samaritan law, also from 2016, protects people who seek help during an overdose from drug possession charges.
Governor Whitmer's Michigan Opioids Task Force, created by executive order in 2022, coordinates the state's response across agencies, while Harm Reduction Michigan runs naloxone distribution (60,000 kits statewide) and NEXT Harm Reduction offers mail-order naloxone to anyone in the state.
Michigan's legal gray area for syringe services means protections can vary sharply by city or county. Check local rules, not just state law, before relying on a program being protected.
